When you create an account, we collect your name, email address, company name, and billing information. Authentication is handled through our third-party provider, Clerk.

Contact Data

You may upload contact lists (CSV files) containing phone numbers, names, and other fields you choose to include. You are responsible for ensuring you have proper consent from your contacts to receive SMS messages.

Message Content

We store the content of messages sent through our platform, including campaign templates, personalization fields, and two-way conversation history.

Usage Data

We automatically collect information about how you interact with our platform, including campaign performance metrics (sent, delivered, read, replied), feature usage, and analytics data.

  • To send messages on your behalf to your opted-in contacts
  • To process payments and manage your subscription
  • To provide customer support and respond to inquiries

4. Content Monitoring and Safety

To maintain a safe platform and enforce our Terms of Service, we may review message content sent through our platform. This includes monitoring for:

  • Threats of violence, death threats, or intimidation
  • Sexually explicit or inappropriate content
  • Hate speech and discriminatory content
  • Illegal activity, fraud, and scams
  • Harassment, bullying, and abuse
  • Content involving the exploitation of minors

When our systems detect a violation, we automatically log the following information:

  • Your user identity (name, email, account ID)
  • The full content of the blocked message
  • The category of violation detected (e.g., threats, sexual content, hate speech)
  • The context in which the violation occurred (e.g., chat message, campaign, MMS)
  • The date and time of the attempt

We track the number of violations per account. This data is used to enforce our Terms of Service, identify repeat offenders, and take appropriate action including account suspension or termination. We may also report violations and share logged data with law enforcement authorities where required or appropriate. Violation records are retained indefinitely for safety and legal purposes.

5. Data Sharing

We do not sell your personal information. We may share data with:

  • Service Providers: Third-party services that help us operate our platform, including cloud hosting (Convex), authentication (Clerk), payment processing (Stripe), and SMS gateway providers (Telnyx).
  • Telnyx: Message content and recipient phone numbers are transmitted through Telnyx's SMS API to deliver your campaigns.
  • Legal Requirements: When required by law, court order, or governmental authority.

6. SMS and Mobile Information

When end users (your contacts) provide their mobile phone number and consent to receive SMS messages through your use of UserChat, the following applies:

  • No selling or sharing of mobile information: We will not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or personal information collected through SMS opt-in to any third party for promotional or marketing purposes. Any sharing of data is strictly limited to service providers essential for delivering the messaging service (e.g., Telnyx for SMS delivery).
  • Message frequency: Message frequency may vary depending on the campaigns and communications configured by the business using UserChat.
  • Message and data rates: Standard message and data rates may apply depending on the recipient's mobile carrier and plan.
  • Opt-out: Recipients can opt out of SMS messages at any time by replying STOP to any message. Once opted out, no further messages will be sent unless the recipient re-subscribes.
  • Help: Recipients can reply HELP to any message to receive support information, including contact details for assistance.

7. Data Security

We implement industry-standard security measures to protect your data, including encryption in transit (TLS) and at rest, secure authentication, and regular security assessments. However, no method of transmission over the internet is 100% secure.

8. Data Retention

We retain your data for as long as your account is active. Contact lists, message history, and campaign data are kept for the duration of your subscription plus 30 days after cancellation. You may request deletion of your data at any time by contacting us.

9. Your Rights

Depending on your location, you may have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate or incomplete data
  • Delete your personal data
  • Export your data in a portable format
  • Opt out of marketing communications
  • Withdraw consent where processing is based on consent

10. International Transfers

Your data may be processed in countries other than your own. We ensure appropriate safeguards are in place for international data transfers in compliance with applicable laws.
